1. Introduction
Welcome to Appointments Scheduler ("the App"). These Terms of Use ("Terms") govern your access to and use of the App. By downloading, accessing, or using Appointments Scheduler, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.
2. Description of Service
Bestappoint is an Android application designed to allow authorized persons related to the owner of a business to schedule the appointments of its clients and optionally to notify them via SMS regarding their appointments.
By using this app, clients are less likely to forget about their appointments as they may be be notified via SMS before the appointment.
3. User Responsibilities
3.1 Accurate Information
You are responsible for ensuring that the information you provide within the App, including personal details about specialists and clients, is accurate, current, and complete.
3.2 Compliance with Laws
You agree to use the App in compliance with all applicable laws and regulations. You must not use the App for any unlawful or fraudulent activities.
You agree not to use the App for any illegal or unauthorized purpose, and you agree not to interfere with the functioning of the App or the servers and networks connected to the App.
You further agree that you will not use the App to send marketing messages to clients in any country that prohibits such messages without proper consent.
By using the App, you agree to comply with all applicable laws and regulations regarding the sending of marketing messages.
3.3 Device Security
You are responsible for maintaining the security of your device and any information stored within the App. This includes protecting your device from unauthorized access and ensuring that only you have access to the personal data managed within the App.
4. Use of the App
4.1. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Bestappoint for personal or professional use in accordance with these Terms.
4.2 Restrictions
You agree not to:
- reverse engineer, decompile, or disassemble the App, except as permitted by applicable law.
- reproduce, duplicate, copy, sell, trade, or resell the App or any part of it for any purpose.
- use the App to engage in any activity that could harm, disrupt, or compromise the App or its users.
5. Optional Cloud Backup
If you choose to use the cloud backup feature, you must sign in with your Google account. By doing so, you agree to allow the App to store your data securely in the cloud. You can enable or disable this feature at any time.
6. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
7. Third-Party Services
The App may integrate with third-party services, such as Google Firebase for analytics and crash reporting. By using the App, you acknowledge and agree to the terms of service and privacy policies of these third-party providers.
8. Modifications to the App
We reserve the right to modify, update, or discontinue the App or any features within it at any time without prior notice. We are not liable for any modifications, suspensions, or discontinuations of the App.
9. Termination
We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice, effective immediately. Upon termination, your right to use the App will cease immediately.
10. Limitation of Liability
To the maximum extent permitted by law, Bestappoint, its developers, and affiliated parties shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.
11. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted or error-free.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within Romania to resolve any disputes or claims arising out of your use of the App.
13. Changes to These Terms
We may update these Terms from time to time. Any changes will be effective immediately upon posting the revised Terms within the App. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.
